The German Chamber is delighted to invite you to join our upcoming event on Data Cross-Border Transfer on June 2, 2023, in Shanghai.

 

Article 38 of the Personal Information Protection Law provides that the three main compliance mechanisms for the provision of personal information outside of China are (1) to pass a security assessment organized by the Cyberspace Administration of China, (2) to be certified by a professional organization for personal information protection, and (3) to enter into a standard contract stipulated by the Cyberspace Administration of China with the overseas recipient ("Standard Contract"). On February 24, 2023, the Measures for Personal Information Cross-Border Transfer Standard Contract and its annex (namely, Personal Information Cross-Border Transfer Standard Contract) were issued, which will come into effect on June 1, 2023.

 

In this event, the speaker will provide some suggestions and references for enterprises to reasonably respond to the data cross-border transfer compliance requirements based on the Standard Contract mechanism, and their own personal information protection business practice experience.

 

《个人信息保护法》第三十八条规定,向中国境外提供个人信息的三条主要合规路径有,通过国家互联网信息办公室(“网信办”)组织的安全评估路径、经专业机构进行个人信息保护认证路径,以及与境外接收方订立网信办制定的标准合同(“标准合同路径”)。

 

2023年2月24日,《个人信息出境标准合同办法》及其附件《个人信息出境标准合同》发布,自2023年6月1日起施行。在本次活动中,主讲人将基于标准合同路径,结合自身个人信息保护业务实践经验,为企业合理应对数据出境合规要求提供一些建议和参考。
