Even though the environment for intellectual property protection has significantly improved over the last decades, intellectual property infringements and insufficient implementation of laws and regulations is still a concern for a significant number of foreign companies


Here, the German Embassy, the German Consulate Shenyang, the German Chamber of Commerce, and German lawyers are offering a support network for you in China.

 

At this symposium, we will discuss the most recent developments as well as support options for IP-related cases. There will also be plenty of time for individual discussions and networking.

Mr. Haase took post as IP-Counsellor to the German Embassy in Beijing in summer 2020. After graduating from the faculty of law at the Westfälische-Wilhelms-Universität in Münster in 2003, he was in articles (law apprenticeship) i. a. at the German Embassy in Phnom Penh, Cambodia and graduated with his 2nd state examination in law in 2007 (Examination board Düsseldorf).
Mr. Haase started his career as a judge on the bench for the civil district court in Germany and has served as public prosecutor in Cologne, Osnabrück and Aurich (Lower Saxony and North Rhine-Westphalia).
He was stationed in a legal exchange program in Japan in 2013 to interact on the legal systems of both countries. In 2015 Mr. Haase was appointed to the Ministry of Justice and Consumer Protection to the Federal republic of Germany where he i. a. outlined new penal provisions.

Consul General, the Consulate General of the Federal Republic of Germany in Shenyang
Mr. Barkeling took post as Consul General in July 2023. Before that he served as the head of the Economic Department at the German Embassy from August 2020 until July 2023. From 2016 to 2020 he served as Deputy Head of Mission at the German Embassy Jakarta, Indonesia. From 2012 to 2016 he worked in the United States, first as Communications Advisor for the Sustainable Development Network in the World Bank and later as Head of the Economic and Commercial Section at the German Embassy Washington. He was the Personal Assistant to German Federal President Horst Koehler and Deputy Director of his Personal Office.
Mr. Barkeling joined the German Foreign Service in 2000. He studied History, Latin Philology and Law in Münster, Germany and Salamanca, Spain and obtained a master’s degree.

Since August 2018, Jens Hildebrandt is heading the Delegation of German Industry & Commerce Beijing as Delegate & Chief Representative and Executive Director of the German Chamber of Commerce in Chiang - North China. He studied Political Science and Sinology in Leipzig, Beijing and Hong Kong and completed an MBA. Since 2007 Jens Hildebrandt has held various management positions in the network of German Chambers of Commerce Abroad (AHK) and the Association of German Chambers of Industry and Commerce (DIHK), i.e. as Head of the East Asia Department in Berlin and later as Delegate & Chief Representative of German Industry & Commerce in Guangzhou.

Mr. Alex Liu received his M.S. degree in molecular pharmacology from Peking Union Medical Collage and an LLM degree in IP Law from Franklin Pierce Law School (US). Mr. Liu is qualified both as a patent attorney in China and a patent agent in the US. As an experienced patent practitioner working in a multi-national company in China, Mr. Liu is adept at developing IP strategies and managing IP portfolios that position businesses to take advantage of both legal and business opportunities.
As part of his previous practice as an external counsel, Mr. Liu provided expert advice on issues including patentability, validity, infringement, freedom-to-operate, due diligence, etc. After joining Bayer China since 2007, Mr. Liu also helped his company draft and negotiates technology transfer agreements, IP licensing agreements, and other contracts related to IP transaction in the areas of pharmaceuticals, agrichemicals, biotechnology, and medical devices. As now being the IP Head of Bayer China since 2013, he is conducting/coordinating all types of IP issues for the company in the APEC region.

Dr. Falk Lichtenstein

Falk Lichtenstein has been based in China with CMS since 2007. He advises companies on China-related M&A transactions, corporate and commercial issues as well as dispute resolution. This includes establishing and restructuring of subsidiaries and joint ventures, acquisition of domestic Chinese companies, the companies’ distribution structure, regulatory matters, commercial contracts and disputes with local Chinese companies. Falk’s clients comprise foreign companies and their Chinese subsidiaries in the sectors automotive, machinery and equipment, textile, IT technology, food and beverage, life sciences, chemical industry and logistics.
Falk studied law at Rostock and Freiburg universities from 1996 to 2001. From 2001 on, he worked as a teaching and research assistant at the Institute for German and International Civil Procedural Law of the University of Freiburg for more than five years. In 2004, he completed his doctorate. In 2006 he passed the Second Legal State Examination in Baden-Wurttemberg and joined CMS.
Falk is the lawyer of confidence of the Embassy of the Federal Republic of Germany in Beijing.

Daniel Albrecht is a German attorney at law and Managing Counsel of Starke IP. He is also external expert for the EU China IPR SME Helpdesk and arbitrator at the Qingdao Arbitration Commission, member of International Trade Committee of the European Communities Trademark Association (ECTA), member of the MARQUES Cyberspace Team and also member of the Expert Committee, China-Germany Intelligent Manufacturing Industry Association.
Daniel is former member of the board of the German Chamber of Commerce in North China, former Guest Professor for civil law at the China University of Political Science and Law (CUPL) in Beijing and former Guest Professor of the Global Campus of the Union of Western & Eastern Education (UWEE).
He published several articles about Chinese IPR and Cybersecurity related matters.
He specializes in Intellectual Property, corporate law, commercial law as well as labour law. He also assists his clients in drafting and negotiating complex contract documentations.
Starke (Beijing) Intellectual Property Co. Ltd. is a Trademark Agent licensed by the State Administration for Market Regulation (SAMR) of the P.R.C.
