On 22 March, 2024, the Cyberspace Administration of China (CAC) published the Provisions on Promoting and Regulating Cross-Border Data Flows, optimizing and adjusting the Cross-border Data Transfer Regulations, further indicating that data compliance has become one of the most important compliance obligations faced by enterprises in the digital economy era. As long as enterprises use and generate data, they will inevitably be subject to regulatory requirements of relevant laws and regulations. An increasing number of business decisions by enterprises are based on the collection, analysis, and utilization of data. With the continuous expansion of data scale, enterprises should pay high attention to data security and strengthen end-to-end data management. 

3月22日,国家互联网信息办公室公布《促进和规范数据跨境流动规定》,优化调整数据出境制度,进一步表明,数据合规已经成为数字经济时代下,企业面临的最重要的合规义务之一:一方面,企业只要在使用或生成数据,不可避免会受到相关法律法规的监管要求。另一方面,企业越来越多的业务决策是基于对数据的收集、分析与运用。在数据规模不断扩大的背景驱动下,企业应当高度关注数据安全,加强数据全流程管理。


Despite strict data protection laws strengthening regulatory oversight of companies, achieving "data security compliance" remains challenging. Enterprises still face significant fines due to violations of data processes, highlighting the necessity of enhancing vigilance towards data compliance. In this seminar, we briefly guide enterprises to efficiently address data protection challenges through two main themes:

尽管严格的数据保护法律加强了对公司的监管,但实现“数据安全合规”仍然具有挑战性,企业仍存在因数据流程违规而面临巨额罚款的情况,这凸显了提高数据合规警惕的必要性。本次讲座我们通过两个主题简要指导企业高效应对数据保护难题:


1) The impact of Chinese laws and regulations on Chinese enterprises. 中国的法律法规对中国企业的影响;

2) The impact of the General Data Protection Regulation (GDPR) in Germany on enterprises in China with real life examples: 德国GDPR(General Data Protection Regulation)对在华企业的影响:


  • Understanding what constitutes end-to-end data security management. 了解何为数据安全全流程管理。

  • How to avoid security pitfalls in data usage. 简析如何避免数据使用中的安全陷阱。

  • What are the consequences faced by enterprises, especially in data transmission, when not complying with regulations. 分析企业在不遵守规定的情况下,尤其是数据传输方面所面临的后果。

  • Understanding how certification through standard data protection models can minimize risks and ensure the security of your enterprise in the digital environment. 了解通过标准数据保护模型进行GDPR认证如何将风险降至最低,确保您的企业在数字环境中的安全。

She has more than 25 years’ experience in the fields of financial consulting, tax advisory & planning, tax consulting, auditing, FDD and M&A etc.

     

    Ms. Pingwen HU majored in industrial accounting in 1990 and minored in law in 2005, then completed the ITCM top course for international tax in 2010. She was qualified as Chinese CPA since 1994, and subsequently obtained the British FFA membership and the UK IFA senior membership. Ms. Pingwen HU is a member of the ECOVIS International “Quality and Development Management Committee” and member of “Audit Task Force Committee”. She is also a member of the ECOIVS International Supervisory Board as well and mainly responsible for the affair of ECOVIS Asia-Pacific.
