China Customs has launched a special audit on royalties in 2016, initially focusing on the automotive parts sector before progressively extending to other industries. In recent years, Customs' oversight of royalties has intensified, imposing stricter compliance requirements on enterprises and significantly increasing the legal consequences for false declaration of royalties. In the event of non-compliance, the enterprise may directly face the investigation of the anti-smuggling police, resulting in consequences that range from tax compensation and administrative fines to potential criminal liability.
