2025年，中国重新成为德国最大的贸易伙伴。随着中德经贸往来持续深化，德国企业在华进出口业务规模稳步扩大，但中国海关、税务、出口管制等领域的刑事追责规则与德国存在显著差异，合规挑战加剧。近两年，中国海关刑事调查力度持续升级，尤其针对低报价格、瞒报税号、无证出口管制物项等行为开展专项打击，执法领域覆盖机械设备、电器与电子设备、汽车及零部件和化工等德企优势领域。企业如未依法合规开展相关业务，可能面临监管部门调查，并承担相应的法律责任，包括行政处罚或其他法律后果。在进出口活动日益复杂的环境下，如何准确识别刑事风险边界、完善内部合规体系、有效防范潜在法律责任，已成为企业稳健经营的重要课题。

In 2025, China resumed its position as Germany's largest trading partner. As bilateral economic ties deepen, the scale of German enterprises' import-export operations in China is steadily expanding. However, significant differences in criminal liability rules between China and Germany, particularly in customs, taxation, and export control regimes, have intensified compliance challenges. Over the past two years, China Customs has intensified criminal investigations, particularly on under-declaration of value, misdeclaration of HS codes, and unlicensed export of controlled items, this enforcement priorities have concentrated on key industrial sectors where German enterprises hold a competitive advantage such as mechanical equipment, electrical and electronic devices, automotive components and specialty chemicals. Companies that fail to conduct their operations in compliance with applicable laws and regulations may be subject to regulatory investigations and corresponding legal liabilities, including administrative penalties or other legal consequences. Against the backdrop of increasingly complex import and export activities, identifying the boundaries of criminal liability, strengthening compliance frameworks, and proactively mitigating legal risks have become critical to sustainable business operations.

鉴于以上形势，德国商会和北京环球律师事务所合作，特邀请环球海关与贸易合规团队合伙人周和敏律师，为在华经营的德国商会会员举办“企业进出口活动中的刑事法律风险与防范”讨论会。本次讨论会将聚焦近两年海关刑事调查重点和执法动态，结合实战经验和案例，分享他们协助诸多跨国公司客户应对海关刑事调查的实务经验，总结企业应该吸取的教训，提出相应的解决方案。

In view of the above situation, we cooperate with Global Law Office and invite Hemin Zhou, a partner of the Global Customs and Trade Compliance Team, to provide an virtual exchange on " Criminal Legal Risks and Prevention in Import-Export Activities " for German Chamber of Commerce members. This virtual exchange will cover priorities and practice of customs criminal investigations in the past two years, with practical experience and case study, to summarize the lessons learned by enterprises and suggest corresponding practical compliances.
