The State Administration for Market Regulation has released the Provisions on the Protection of Trade Secrets. The new regulation will come into effect on 1 June 2026. The new regulation is constructing a more robust administrative protection system for trade secrets. It serves as a critical benchmark for enterprises to refine their compliance with trade secrets protection, including improving confidentiality systems, optimizing protective measures, standardizing processes of confidential information, etc.
The new regulation also brings significant challenges for businesses, including stricter digital security requirements, heightened liability risks during talent recruitment, exposure to extraterritorial enforcement, a lower threshold for triggering administrative investigations, and substantially increased penalties.
The German Chamber of Commerce in China - East China invites you to a discussion on this topic.
In this exclusive virtual exchange, you can share your experiences and gain from the insights of your peers on topics such as:
· How has the trade secret protection scope expanded and especially what are the responses of this new regulation to the needs for the protection of trade secrets in the digital age?
· How does this new regulation refine the types of acts constituting infringement of trade secrets and the criteria for their determination?
· How have administrative enforcement rules been improved, and how will such improvements benefit right holders in protecting their rights?
Seize this opportunity to gain first-hand insights from experts and peers and engage in an open discussion.
