The State Administration for Market Regulation has released the Provisions on the Protection of Trade Secrets. The new regulation will come into effect on 1 June 2026. The new regulation is constructing a more robust administrative protection system for trade secrets. It serves as a critical benchmark for enterprises to refine their compliance with trade secrets protection, including improving confidentiality systems, optimizing protective measures, standardizing processes of confidential information, etc.

The new regulation also brings significant challenges for businesses, including stricter digital security requirements, heightened liability risks during talent recruitment, exposure to extraterritorial enforcement, a lower threshold for triggering administrative investigations, and substantially increased penalties.
